Terms of Use

These Terms of Use (“Terms”) govern your use of the keeper website (including our pre-launch waitlist) and the keeper mobile app and related services (together, the “Service”), provided by keeper (“keeper”, “we”, “us”, or “our”). By using the Service, joining the waitlist, or creating an account, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use keeper, or older where your local law sets a higher age for consenting to online services. By using the Service you confirm that you meet this requirement and that the information you provide is accurate. If you are under the age of majority where you live, you may use keeper only with the involvement of a parent or guardian.
2. The waitlist
Joining the waitlist registers your interest in keeper. It does not create an account and does not guarantee that you will receive access, or access by any particular date. Invitations are limited and issued at our discretion. We may change, pause, or discontinue the waitlist or the product at any time.
3. Your account
- You are responsible for the activity on your account and for keeping your login credentials secure.
- You must provide accurate information and keep it up to date.
- You may not impersonate others, create an account for someone else without authorization, or use the Service if we have previously terminated your account.
- Notify us at support@getkeeper.social if you suspect unauthorized use of your account.
4. Your content
You own the content you create on keeper, including your photos, keeps, ratings, comments, and lists (“Your Content”). By posting Your Content, you grant keeper a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display it solely to operate and provide the Service to you and the people you share it with. This license ends when you delete Your Content or your account, except for content others have re-shared and for backups or records we are required to keep.
You are responsible for Your Content and confirm you have the rights to post it. Do not post content that infringes anyone’s intellectual-property or privacy rights.
5. Acceptable use
You agree not to use keeper to:
- post objectionable content, including content that is unlawful, harassing, hateful, abusive, threatening, defamatory, sexually explicit, or that depicts or promotes violence;
- harass, bully, stalk, threaten, or harm another person;
- post spam, scams, or misleading or fraudulent content;
- violate any law or another person’s rights;
- attempt to access accounts or data that are not yours, or probe, scan, or breach the security of the Service;
- scrape, reverse-engineer, or misuse the Service or interfere with its normal operation.
Zero tolerance for objectionable content and abusive behavior
keeper has no tolerance for objectionable content or abusive users. You can report any content or account, and block any user, directly in the app. We review reports and aim to remove violating content and to act on abusive users within 24 hours, up to and including removing content and terminating accounts. Repeated or serious violations result in a permanent ban.
6. Reporting and moderation
Reporting and blocking tools are available throughout the app. We may remove content, limit features, or suspend or terminate accounts that violate these Terms, with or without notice. We are not obligated to monitor all content but may do so.
7. Feedback and support
If you send us feedback, a support request, a report, or otherwise contact us, you agree that we may respond to you by email at the address associated with your account. These are service-related communications about your request; we will not repurpose them for unrelated marketing. You also grant us the right to use feedback and suggestions you send without obligation to you.
8. Third-party services
keeper relies on third-party services (for example, mapping and place data, authentication, push notifications, and error reporting). Their content and availability are outside our control, and your use of features that depend on them may be subject to their terms. Restaurant and place information is provided for convenience and may be inaccurate or incomplete.
9. Our intellectual property
The keeper name, logo, app, website copy, design, and software are owned by keeper and protected by law. We grant you a limited, personal, non-transferable, non-exclusive license to use the Service for its intended purpose. You may not copy, modify, distribute, or create derivative works from the Service except as allowed by these Terms or applicable law.
10. Termination
You may stop using keeper and delete your account at any time from Settings → Delete account in the app. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service or its users. Sections that by their nature should survive termination (such as content licenses for already-shared content, disclaimers, and limitations of liability) will survive.
11. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or that content (including restaurant information) will be accurate.
12. Limitation of liability
To the maximum extent permitted by law, keeper and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim (if any) or USD 50. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under mandatory law that cannot lawfully be excluded, for example the Australian Consumer Law. Where such a right applies and cannot be excluded, our liability is limited to what that law permits.
13. Indemnification
You agree to indemnify and hold keeper harmless from claims, damages, and expenses (including reasonable legal fees) arising from Your Content, your use of the Service, or your violation of these Terms or the rights of others.
14. Changes to these Terms
We may update these Terms from time to time. When we do, we will change the “Last updated” date above, and for material changes we will provide notice in the app or by email. Your continued use of the Service after an update means you accept the revised Terms.
15. Governing law
These Terms are governed by the laws of New South Wales, Australia, without regard to its conflict-of-laws rules. Any dispute will be resolved in the courts located there, unless applicable law requires otherwise.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
17. Apple App Store
If you download keeper from the Apple App Store, Apple’s standard Licensed Application End User License Agreement also applies to your use of the app, and Apple is not responsible for the app or its content.
